Florida Senate Passes Condominium Reform Bill to Boost Safety and Transparency


On May 2, the Florida Senate passed Senate Bill 1742 / House Bill 913, focused on reforming condominium and cooperative association governance. Sponsored by Senator Jennifer Bradley (R-Fleming Island) and co-introduced by Senator Jason Pizzo (NPA-Sunny Isles Beach), the legislation aims to improve safety, oversight, and financial flexibility for condo associations across the state.


Key Highlights:


1. Prioritizing Safety Repairs. The bill gives associations more flexibility to address critical safety issues first, particularly those found during milestone inspections. Associations may temporarily reduce reserve contributions or use lines of credit to cover essential repairs, allowing them to act quickly without immediate full funding.


2. Strengthening Transparency and Accountability to prevent conflicts of interest:


  • Professionals conducting Structural Integrity Reserve Studies (SIRS) must disclose if they intend to bid on any resulting repair work.

  • Contractors performing the repairs must disclose any ties to the firm that conducted the SIRS.


3. Collaborative Reform The legislation was shaped through months of input from condo owners, local governments, state regulators, and industry stakeholders. Senate President Ben Albritton praised the bill for ensuring condo communities remain a safe and attractive housing option, especially in coastal areas popular with retirees.
